The five step process
Step 1. Free case review.
You fill out a two minute form or call us directly. We ask about your implant date, your complications, and your medical history. There is no fee, no obligation, and no pressure. If you don't qualify, we will tell you. If you do, we move to step 2.
Step 2. Medical records collection.
We collect your operative report, imaging, follow up records, and any documentation of revision or fusion surgery. We handle this. You sign authorizations. We do the work.
Step 3. Case evaluation.
We review the medical evidence against the MDL criteria. We confirm the device was a Cartiva (many patients don't know the brand of their implant until we pull the records). We confirm the timeline fits within the statute of limitations for your state.
Step 4. Filing.
We file your case in federal court. Because the MDL is consolidated in the Eastern District of Arkansas, the case will be transferred there for coordinated proceedings.
Step 5. Discovery and resolution.
The MDL court manages discovery. We participate in coordinated proceedings on your behalf. As the MDL moves toward bellwether trials or settlement negotiations, we represent your interests at every stage.
How long does a Cartiva case take?
Mass tort litigation is not fast. From filing to resolution, typical timelines run 18 to 36 months. Some cases resolve faster through individual settlement. Others take longer if they go to trial. We will give you realistic expectations from day one.
What it costs you
Nothing up front. We work on contingency. We only get paid if we win your case. There are no hourly fees, no retainers, and no surprise bills.
If we win, we receive a percentage of the recovery, plus reimbursement for case expenses. We discuss the exact terms with you in writing before you sign anything.
